1. HOW TO ENTER
a. The K-EARTH Spooktacular PHOTO contest (the “Contest”) will begin on Monday, October 8th, 2007 at 5:00 am and end on Wednesday, October 26th, 2007 at 10:00 am (the “Contest Period”).
b. To participate in the Contest, you may enter via the following methods:
Online:
Log on to www.MYKEARTH101.com during the Contest Period and clicking on the Universal Studios Halloween Horror Nights logo located on the K-EARTH homepage. Participants must enter their first and last name, complete address, city, state, zip code, home telephone number, date of birth, a valid email address, their school name and attach their photo on the online entry form. Only one (1) Internet entry per person and one (1) Internet entry per email address are permitted. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by the Internet access provider, online service provider or other organization that is responsible by assigning email addresses or the domain name associated with the submitted email address. Multiple participants are not permitted to share the same email address. All entries submitted become the sole property of K-EARTH 101 and will not be acknowledged or returned. Use of any device to automate entry is prohibited. Proof of submission of an entry shall not be deemed proof of receipt by K-EARTH 101. K-EARTH 101’S computer is the official time keeping device for this Contest.
Participants may also attach the photo to an email along with their first and last name, complete address, city, state, zip code, home telephone number, date of birth, a valid email address, and their school name.
US MAIL OR IN PERSON:
Participants may submit their photo on CD-R in person between the hours of 9:00am-5:00pm Monday through Friday or via US Mail to K-EARTH 101, 5670 Wilshire Blvd. Suite 200, Los Angeles CA 90036, along with their first and last name, complete address, city, state, zip code, home telephone number, date of birth, and their school name.
c. Photo should be spooky, creative, Halloween-themed, and possibly involve K-EARTH 101. Contestant and/or parent or legal guardian should be the only people to appear within the submitted photo. For online entries, photos must be no more than 5MB, in jpeg format. For mail in or in person entries, photos must be on CD-R.
d. For online entries, K-EARTH 101 is not responsible for entries not received due to difficulty accessing the Internet, service outage or delays, computer difficulties or other technological glitches. For entries by mail, K-EARTH 101 is not responsible for lost, stolen, mangled, misdelivered, illegible, incomplete or late entries.
e. ALL ENTRIES MUST BE RECEIVED BY MIDNIGHT, MONDAY, OCTOBER 15, 2007.
f. Limit one entry per person.
2. ELIGIBILITY RESTRICTIONS
a. The Contest is open to all K-EARTH 101 listeners who are between the ages of 13 to 17 at the start of the Contest Period, U.S. residents, and who reside in the following Counties: Los Angeles, Orange County, San Bernardino, Riverside and Ventura. Employees of K-EARTH 101, its licensee, its Parent Corporation, subsidiaries and affiliates, their advertising agencies, participating sponsors/promotional partners, other radio stations in the Los Angeles, Orange County, San Bernardino, San Diego, Riverside and Ventura metropolitan areas and the members of their immediate families are ineligible to participate or win. Subject to all applicable federal, state, and local laws. Void where prohibited.
b. Contestants must have permission from parent or legal guardian to enter the Contest. Parents or legal guardians of contestants must possess valid government issued photo ID, and might sign any required Affidavit of Eligibility and/or Release of Liability Prize Acceptance Form in order for prize to be awarded.
c. Listeners are eligible to win a K-EARTH 101 contest with a prize value of $75 or more only once every sixty days and a prize valued at $600.00 or more only once every six months. Only one winner per household is permitted in any contest.
d. Entrants are required to provide truthful information and K-EARTH 101 will reject and delete any entry that it discovers to be false or fraudulent. K-EARTH 101 will disqualify any entry from individuals who do not meet the eligibility requirements, and K-EARTH 101 will also delete any entry received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act.
e. Each Photo entry must be the original creative photographic work and/or property of the contestant and must not contain copyrighted material or any other materials, which may be restricted, prohibited or outlawed by Federal, State or Local laws. All PHOTO entries and their content become the property of K-EARTH and will not be returned. K-EARTH in it’s sole discretion reserves the right to disqualify and/or destroy any photo entry if such photo entry contains illegal, indecent, pornographic, sexually explicit content or otherwise offensive material such as aberrational behavior graphic violence or drug use, or if such photo entry contains material whose content is deemed at the sole discretion of K-EARTH to be unsuitable for public viewing or posting via the Internet. No person or animal may be injured in making the photo entry.
3. PRIZES
a. One (1) grand prize will be awarded. The grand prize is a Dell laptop computer with an Approximate Retail Value of up to $500 for a grand total of up to $500. Also, the winner’s homeroom classroom and cafeteria (only with permission of school principal) will be decorated for Friday, October 26th, 2007 by K-EARTH 101 Street Team and set designers. If permission is not granted at winner’s school of choice, an alternate site may be decided solely at sweepstakes administrator’s option.
b. Up to four (4) runners up prizes will be awarded. Each prize includes one (1) set of 4 tickets to Universal Studios Hollywood Tour’s Halloween Horror Nights on October 31st, 2007 [ Value of $200]
c. All prizes may be picked up at the office of K-EARTH 101 5670 Wilshire Boulevard, Suite 200, Los Angeles, CA 90036. The winner will forfeit any prize not claimed by October 31st, 2007. In the event that a prize certificate is mailed to a winner, it will be with prior written consent of the winner and therefore, winner assumes the risk of its loss. K-EARTH 101 is not responsible for the safe arrival of prize.
d. There is no substitution or transfer of prizes, except that Sponsor may, at its sole discretion, substitute prizes of comparable value. The prizes are expressly limited to the items listed above and do not include taxes. Other restrictions may apply.
4. WINNER SELECTION AND NOTIFICATION
a. Decisions of K-EARTH 101 management with respect to the Contest are final.
b. On Tuesday, October 16th, our judges, the K-EARTH 101 Morning Show on-air personalities will pick five (5) entries as finalists from all eligible entries received. Finalists will be judged on how spooky, creative, Halloween-themed, and K-EARTH 101 related their photo is. Finalists will be picked using these criteria solely at the discretion of the judges reviewing each entry.
c. After our judges have chosen the five finalists and signed releases from the finalists have been received, voting will begin and continue through Tuesday, October 23rd, at 5:00pm. K-EARTH 101 “All Access Members” only will be able to vote by logging on to www.mykearth101.com and clicking on the Universal Studios Hollywood logo located on the K-EARTH 101 home page. The logo will link to a splash page with the five qualifying photos. Listeners will be able click and vote on the photo they deem qualified based on their opinion. Only one vote per person, per email address. To become an All Access Member log on to www.mykearth101.com. Membership is free.
d. On Wednesday, October 24th at 10:00 am, all listener votes will be tallied. The qualifying photo with the highest number of votes will be determined as the grand prize winner. Should there be a tie in the number of votes; a random drawing will determine the winner from the two or more contestants with the same number of votes.
e. The winner’s photo entry will be posted on K-EARTH 101’s website for public viewing.]
f. Winner will be notified by phone on Wednesday, October 24th, 2007.
g. Winner need not listen to participate and win.
h. Parents or legal guardians of winners must execute and return any
Required Affidavit of Liability and/or Release of Liability Acceptance Form, by October 23rd, at 5:00pm or prize will be forfeited and alternate winner is chosen. If a potential winner cannot be contacted, fails to sign and return the required affidavit of eligibility and liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, potential winner forfeits prize and person with the next highest amount of votes is the alternate winner.
5. CONDITIONS
a. Payment of all federal, state and local taxes will be the sole responsibility of the winner and/or legal guardian. Winners and/or their legal guardian(s) may be required to sign an IRS Form W-9 or the equivalent.
b. By participating in the Contest, participants, winners, and parents or legal guardians agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this Contest without additional notification or compensation (financial or otherwise). The winner or winners (and their guest or traveling companion, if any) agree to sign a publicity release authorizing the same prior to acceptance of a prize.
c. Prior to awarding any prize or prize certificate, K-EARTH 101 in its sole discretion may require Contest winners and parents or legal guardians to sign a liability release, agreeing to hold K-EARTH 101, its corporate licensee, its parent, subsidiary and affiliated corporations, and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the Contest.
d. K-EARTH 101, in its sole discretion, reserves the right to disqualify any person tampering with the entry process, the operation of the K-EARTH website or who is otherwise in violation of the rules. K-EARTH 101 further reserves the right to cancel, terminate or modify the Contest if it is not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort.
e. K-EARTH 101 reserves the right to make changes in the rules of the Contest, including the substitution of a prize or prizes of equivalent or greater value, which will become effective upon announcement. If due to circumstances beyond the control of K-EARTH 101, any competition or prize related event is delayed, rescheduled, postponed, or canceled, K-EARTH 101 reserves the right, but not the obligation, to cancel or modify the Contest and shall not be required to substitute prize.
f. Failure to comply with the Contest rules may result in a contestant’s disqualification, at the sole discretion of K-EARTH 101.
g. K-EARTH 101 is not responsible for typographical or other errors in the printing, the offering or the administration of the Contest or in the announcement of a prize.
h. Copies of the written Contest rules and a list of all winners are available during regular business hours at the main studio of K-EARTH 101, 5670 Wilshire Boulevard, Suite 200, Los Angeles, CA 90036, or by sending a self-addressed stamped envelope to K-EARTH 101.
